My ex-spouse won't let me see my kids because I haven't paid child support...
Question:
My kids live with my ex but our separation agreement says I can visit with them for at least one afternoon or evening a week, which I usually do. I am behind on my child support payments and now my ex says I can't see the kids until I'm all paid up. Can my ex do that?
Answer:
No, the right of your children to see you, and you to see them, cannot be denied because you haven't paid support. If you continue to not pay the full amount, your ex has other ways to enforce payment. If you cannot keep up the payments because of a big change in your situation, you can see if your ex-spouse will agree to change the amount, or you can get legal advice about trying to change it.
